General Terms and Conditions

for orders from Switzerland in the AIREX® online shop

1. Scope and contracting party

These terms apply to all orders with a delivery address in Switzerland [[OFFEN: and Liechtenstein?]] placed via the AIREX® online shop (country selection “Switzerland”). Your contracting party and the seller is SCHOELLKOPF AG, Riedackerstrasse 20, 8153 Rümlang, Switzerland, phone +41 44 315 50 15, info@schoellkopf.ch, UID CHE-107.409.164. The online shop and website are operated and owned by Airex AG, Industrie Nord 26, 5643 Sins (manufacturer), which is not a party to the purchase contracts.

2. Conclusion of contract

The presentation of products is not a binding offer. By clicking “Order with obligation to pay” you place a binding order; before that you can review and correct all details. We confirm receipt by email. The contract is concluded with our order confirmation or the dispatch of the goods. Contract languages are German and English.

3. Prices

All prices are in Swiss francs (CHF) including VAT. Any shipping costs are shown in the checkout and on the page Shipping & payment.

4. Delivery and payment

We deliver within Switzerland [[OFFEN: and to Liechtenstein]]. You can pay with the payment methods offered in the checkout, in particular TWINT and PayPal [[OFFEN: further methods]].

5. Returns

We voluntarily grant you a return right of 10 days from receipt of the goods. Please return the goods unused, complete and if possible in the original packaging, and notify us in advance at info@schoellkopf.ch. The costs of returns under the voluntary return or exchange right are borne by the customer. Unpaid (carriage forward) parcels will not be accepted. The goods must be adequately protected for return shipping and packed in a suitable shipping box. If the goods or the original packaging are damaged due to inadequate packaging, a corresponding reduction in value may be charged. We refund the purchase price within 14 days of receiving the goods using the original payment method.

6. Warranty

The statutory warranty under Art. 197 et seq. of the Swiss Code of Obligations applies; for new products the limitation period is two years from delivery. Please report defects to info@schoellkopf.ch as soon as possible. We will remedy the defect by repair or replacement at our discretion; if this is not possible, you are entitled to a price reduction or refund.

7. Liability

We are liable for damage caused intentionally or through gross negligence and under the Product Liability Act. Otherwise, liability is excluded to the extent permitted by law.

8. Applicable law and jurisdiction

Swiss law applies, excluding the CISG. For claims by consumers, the mandatory places of jurisdiction of the Swiss Civil Procedure Code (Art. 32 CPC) apply. Otherwise, the place of jurisdiction is Zurich.
